Asset Confiscation Matters

Property is confiscated when it is given or taken in satisfaction of a person's liability to pay the amount in an unexplained wealth declaration, a criminal benefits declaration or a crime used property declaration. Frozen property is confiscated if an objection to the confiscation is not lodged within 28 days from the date of service.

A person declared or taken to be a drug trafficker may have confiscated all the property that the person owns or effectively controls at the time the declaration is made and the property that the person gave away at any time before the declaration was made (sections 6 - 8 of the Criminal Property Confiscation Act 2000).
