Bail Applications

Bail is a written promise or undertaking that you will attend court at a certain time and comply with any other conditions in the undertaking. If a person fails to attend Court or breached a condition of their bail, an arrest warrant may be issued for that person, and if convicted, the person may be liable for imprisonment for up to 3 years and a fine of up to $10,000.

If a person on bail commits a serious offence (as prescribed in Schedule 2 of the Bail Act 1982) whilst on bail, the person will remain in custody unless the person applying for bail can show that exceptional circumstances exist justifying their release from custody. If a bail application is unsuccessful, a person cannot re-apply for bail unless there is a change in the person's circumstances.
